Franchise disclosure document where we are current franchisees. the franchisor claims to be the sole distributor, sponsor of a Class 1 Medical device. A thorough search has revealed he is not the sponsor/distributor of the device in use, someone else is. TGA advise that the device serial numbers must be registered with the sponsor, a number of devices have not been. Any fines etc are the responsibility of the franchisor. My question is does a franchisees Public Liability become void in the event of some sort of injury to a client if the franchisor has not properly registered the serial numbers of the devices with the sponsor of the device? There are other issues that go to Deceptive and Misleading Conduct with this franchisor so I will have further work and questions.

Hello, I am trying to work out who to take to Magistrates court for breach of contract and refund of money paid. I have taken my case to the WA Department of Consumer Protection who were unable to conciliate due to parties not being willing. Background: - I signed a contract for service and made full payment of $885 on 22/10/15. - The business was apparently sold in July 2016. - The new owner was a staff member of the business and had been my customer service representative since March 2016. - In December 2016 I requested termination of the contract and part refund of money due to the service not being what I paid for. - The new owner informed me that I was not actually a client of hers as she had not acquired the liabilities of the business from the previous owner - she has the business name, database, equipment, and premises. She told me that I would have to contact the original owner as that apparently is who my contract is with. She would not give me the details of the previous owner as she has been ordered not to by the previous owner's lawyers. - At no stage was I informed that the business was being sold nor that my contract for service was going to be ignored. I asked the new owner why she did not inform existing clients of this new arrangement and she has not answered that, however told me that she continued doing business with me out of "good will". Additionally, she has told me that she will not "liaise" with me anymore because I had reported her business to DOCP. - The other parties to my contract are listed as Louray Pty Ltd (WA) trading as Just Coffee and ABN 60919861577. I have performed an ASIC search and found that the sole shareholder and Director of each company is the same person. Question: I feel that I have been misled by the new owner, however, if what she says is true about not acquiring the business liabilities then the original owner had no intention of fulfilling the contract. I am not sure who is currently party to my contract and therefore who I should take to Magistrates court. Are you able to provide advice on this?

My landlord insurance agency sent me an email on August 24 confirming that they would pay me 15 weeks of rent default. On September 29 they sent me another email stating that they would pay me only two weeks rent default less any excess or management commission. Are they allowed to simply change their minds on this? Below is a quote taken from the first email: " I have reviewed all of the information provided and can confirm as below. 1. ‘loss of rent – tenant default’ As the tenant arrears began during the fixed term agreement and they never caught up I am able to provide the maximum policy cover of up to 15 weeks rent default, or until a new tenant is found, whichever comes first. Per the information provided the rent was $350 per week and the accumulatively the rent was paid to 28/03/16 (per agent email to tenant). - First 4 weeks are not covered by policy: 29/03/16 to 25/04/16 - Can provide cover from 26/04/16" Below is a quote taken from the second email: "A full review of the claim determines that the rent was paid up to 21.03.2016. The Tenancy agreement lapsed onto a periodic agreement on 26.12.2015 When a tenancy agreement is periodic the most we will pay for reimbursement of rent default is 2 weeks less any excess or management commission." The landlord insurance agency is in possession of documents (bank account spreadsheets) as evidence that the rent was not "paid up to 21.3.16". The tenant was in rent default during the fixed term lease and had agreed to go on a payment plan to pay the default amount. These documents were sent on August 23 and were obviously used in the initial insurance agency claim review/confirmation email.

There is two entries in the business account his uncle named "money for taxes". We have just learnt that his uncle has not paid any taxes at all. He is going to start another business on his own and we think he used the money to finance it. . Not only that but he has been drawing all the money of the business account for the last few weeks and leaving nothing for my boyfriend. As my boyfriend cant pay rent, now I am struggling with money too. Im starting to get very scared we are going to loose everything we have! We think he has been doing other "dodgy" things, but cant check because he has all the paperwork. My boyfriend keeps hoping his uncle is going to end up doing the right thing and believes there is nothing he can do without making things worse for himself. I understand that it is a partnership and my boyfriend, despite the fact that he didn't know anything, will be responsible for half of the taxes money, but is there anything we can do to fix this situation from a legal point of view??

I am an employee. Amount is approx $100,000 They are implying that if I cooperate and make it easy for them then they may be able to work out a way for me to repay and not get charged. I am not sure I believe that, but even if I do then I cannot repay it, the money is gone. So I assume charges will follow. So they want my bank details at 9am in 30 minutes. Do i help them and hope my cooperation is looked upon favorably, or refuse and wait to get charged.Should I do this and be cooperative or wait until charged?Also what are those charges and penalties likely to be, and should I engage a lawyer and which type before they happen?
